
Terms & Conditions
Please read the following important terms and conditions carefully before agreeing to complete any motorcycle coaching and ensure they do not contain anything that you are not willing to agree to.
1. HOW TO CONTACT US
1.1 How to contact Ride Wise. You can contact us by telephone on 07444 189 061 or by emailing nealethompson@hotmail.co.uk.
2. COACHING CONTRACT
2.1. How we will accept your booking.
Acceptance of any booking takes place when we have received a deposit for a coaching session, a contract will come into existence between you and Ride Wise at this point.
2.2. Other relevant terms.
By completing the Ride Wise Rider Declaration form you agree to be legally bound by the declaration, which is required before Ride Wise can provide coaching. This declaration must remain true on each subsequent day that you undertake coaching and the declaration forms part of this contract as though set out in full here.
3.THE RIGHT TO MAKE CHANGES
3.1. If you wish to make a change to the date of your coaching, please contact Ride Wise, in writing, as soon as possible. Every effort will be made to accommodate changes and rearrange your booking.
3.2. Cancelation or postponement:
3.2.1. If you cancel or postpone an agreed coaching day with more than 7 days written notice there will be no charge.
3.2.2. If you cancel or postpone an agreed coaching day with less than 7 days written notice Ride Wise will refund your payment, less your deposit or alternatively you can transfer the booking to a new date at no additional charge.
3.2.3. If you cancel or postpone an agreed coaching day with less than 24 hours written notice, Ride Wise will NOT refund any of your payment for that day. Transferring the booking to a new date will result in an additional charge.
4. RIDE WISE RIGHT TO MAKE CHANGES
4.1. Minor changes to coaching. Ride Wise occasionally may have to make minor changes to coaching to reflect relevant laws and regulations. Any changes will not affect the overall coaching service provided.
4.2. Significant changes to coaching. Ride Wise may have to make more significant changes to these terms or coaching, however we will notify you as soon as possible and should you not be satisfied with any proposed changes you can end your contract before the changes take effect and a full refund will be issued.
5. YOUR RESPONSIBILITIES.
5.1. Ride Wise can only provide coaching if you comply with the following, that you::
5.1.1. provide your own roadworthy motorcycle with appropriate insurance, current MOT certificate and road tax;
5.1.2. have a valid, full current driving licence relevant to the motorcycle you will riding during the coaching;
5.1.3. complete, and return the Ride Wise Rider Declaration prior to any coaching;
5.1.4. comply with the terms of the Ride Wise Rider Declaration throughout the duration of the coaching.
6. PROVIDING COACHING
6.1. When will Ride Wise provide coaching. Ride Wise will supply coaching services on the date or dates set out in the booking or otherwise later agreed by both parties.
6.2. Delays beyond our control. Should coaching have to be cancelled as a result of something outside of our control, for example poor weather conditions or local restrictions on movement such as covid 19, then we will contact you as soon as possible to explain what steps we will take to minimise the effect of the delay or cancellation. Provided we do this we will not be liable for the delay or cancellation caused by such an event. If this happens, we may need to agree a different date or dates for coaching.
6.3. If you fail to comply with your obligations contained in the Ride Wise Rider Declaration (see clause 5) or you provide incomplete or incorrect or false information/documents, we have the right to either end the contract or delay the coaching. Ride Wise will not be responsible for providing the coaching later than the agreed appointment time or not providing any coaching if this is caused by you not providing the required information.
6.4. Reasons to delay coaching. Ride Wise may have to delay, reorganise or cancel coaching services to reflect changes in relevant law or regulatory requirements, due to poor weather conditions or any restrictions on movement.
6.5. Your rights if we have to delay coaching. Ride Wise will always contact you in advance to tell you if coaching needs to be delayed, reorganised or cancelled, unless the problem is urgent or an emergency. Where ever possible Ride Wise will provide a new date or dates for coaching as soon as possible. You may be able to end the contract as a result of our delay (see clause 7.1.2.).
7. YOUR RIGHTS TO END THE CONTRACT
7.1. How to end the contract due to something we have, or are going to do. If you end the contract for reason at 7.1.1 to 7.1.3 below, your contract will end immediately and Ride Wise will refund you in full for any coaching not provided or not provided properly to you. Those reasons are:
7.1.1. you are notified of an error or change to the price, description or terms of the coaching and you do decide not to proceed;
7.1.2. should we delay or advise you that we intend to delay the coaching, for a period of more than four weeks; or
7.1.3. you have a legal right to end the contract as a result of something we have done wrong.
7.2. Changing your mind. If you have entered into this contract over the telephone or by email, you have a legal right to change your mind within 14 days of the date we entered into this contract, providing the coaching is not within that 14-day period and receive a refund for coaching which has not been provided.
8. OUR RIGHTS TO END THE CONTRACT
8.1. If you break the contract. Ride Wise may end the contract at any time if:
8.1.1. you do not make payment in accordance with clause 10.3 below;
8.1.2. you do not provide information necessary to provide coaching;
8.1.3. your actions are unsafe or illegal for you to ride during coaching; or
8.1.4. you do not comply with your obligations (see clause 5) or the Ride Wise Rider Declaration.
8.2 If we end the contract in the situations set out in clause 8.1 above Ride Wise will not refund your deposit. If your circumstances change please contact us as soon possible and we will look rearrange your coaching dates.
9. IF THERE IS A PROBLEM WITH THE COACHING.
9.1. Your legal rights. The Consumer Rights Act 2015 gives you certain legal rights. For detailed advice, please visit the Citizens Advice website (www.adviceguide.org.uk) or call 03454 040506.
9.2. Tell us about problems. If you have any questions or complaints about the coaching, please contact Ride Wise in writing at (email address here)
10. PRICES AND PAYMENT
10.1. Prices for the coaching. The price of coaching will be the price confirmed at the date of your booking. Ride Wise takes all reasonable care to ensure the prices of the coaching advised to you are correct. If you believe you have been charged incorrectly let us know promptly.
10.2. When and how you must pay. You must pay a £50 deposit at the time of booking and the remaining balance in full, at least 21 days in advance of the date the coaching taking place. If your coaching is less than 21 days then full payment will be required at the time of booking. We accept bank transfer only, at the time of booking. Your deposit can be retained in certain circumstances (see clause 3.2.).
